Network Device Limited Liability Waiver

Nivek Group, and/or their Partners, may be requested to connect to a Network Device (ie Router, Firewall, Switch, Access Point, etc). While Nivek Group, and/or it’s Partners, are connected to one of these network devices, we may be required to apply Firmware Updates and or Additional Security Updates. While applying these updates, it may require for us to perform additional updates and/or changes resulting in additional time for support. Sometimes, there may become a time that there is such of a thing of Data Loss. Nivek Group, and/or it’s Partners, will do everything that they are able to do to prevent data loss. As part of the prevention to prevent data loss, Nivek Group, and/or it’s Partners, will perform a backup prior to starting the task at hand. In the event that there is any sort of data loss or additional support to try and recover the data loss, Nivek Group and/or it’s Partners cannot be and will not be held liable for the loss of data, down time of business production and/or additional support time incurred for this recovery/update time.

Server/Workstation/Laptop/Desktop - Software Support - Limited Liability Waiver

Nivek Group, and/or their Partners, may be requested to connect to a Server, Workstation, Laptop and/or Desktop for support. Part of the support may contain in updating the Operating System Firmware/Software along with the Drivers of the Server, Workstation, Laptop and/or Desktop along the applications that it hosts/uses. This support may require updates to some of the security functions and/or features. While performing the updates to the Server, Workstation, Laptop, and Desktop, it may require Additional Support Time and/or some Down Time for one or more users within the company. Nivek Group, and/or it’s Partners cannot and will not be held liable for any additional support and/or down time for this to take place. Prior to starting any type of support on a server, Nivek Group, and/or it’s Partners, will perform a backup. This backup is to help mitigate any type of Data Loss. Nivek Group, and/or it’s Partners, shall not be held liable for any type of Data Loss as long as they were following proper protocols of performing the backup prior to starting any type of work.

Server/Workstation/Laptop/Desktop - Hardware Support - Limited Liability Waiver

Nivek Group, and/or it’s Partners, may be requested to perform updates to a server’s hardware, software and/or firmware. While performing these updates, it may require updates and/or upgrades to other hardware components. To be able to perform  these updates, it may result in downtime of work productivity and/or additional support time resulting in additional charges. If there are additional support support time and/or additional charges, Nivek Group, and/or it’s Partners, will not and cannot be held responsible for these additional charges and/or fees for loss of productivity due to downtime.

Loss of Data - Any Type - Limited Liability Waiver

Nivek Group, and/or it’s Partners, will do everything within their powers to prevent any type of data loss. The standard process is for us to perform a backup of the most recent data that is possible with the tools that is available for each client. In the event, that there is any type of data loss, Nivek Group, and/or it’s Partners, cannot be help liable for any type of data loss that is outside of our control due to software, hardware and/or firmware updates.

Loss of Service Due to Hardware Failure - Limited Liability Waiver

Nivek Group, and/or it’s Partners, may be requested and/or required to perform an update to the hardware of a Network Device, Server, Workstation, Laptop and/or Desktop. Such update requests and/or requirements may be due to Client Requests, End User Requests, Software Requirements, Hardware Requirements and/or Manufacture Requests or Requirements. In the process of performing these updates, Nivek Group, and/or it’s Partners, will do everything within their powers available to prevent any downtime, loss of data and/or additional costs to perform the necessary functions and/or updates. In the event of any Loss of Service, Downtime or Loss of Data due the the results of the changes, updates and upgrades requirements, Nivek Group, and/or it’s Partners, cannot and will not not be held liable. 

Inclusion

Inconclusion, Nivek Group, and/or it’s Partners cannot be help liable for any additional charges, replacement of hardware items and/or software updates along with the loss of data that is outside of their control. As long as Nivek Group, and/or it’s Partner’s, does everything within their powers and knowledge to help prevent any of the above.
